If you’re in business, you’ve likely heard a lot about the importance of contracts. Business transactions used to be a simple matter of two people agreeing to a trade and honouring their word. But in the 21st century, professional businessmen know that deal-breaking and lawsuits are an unfortunate reality.

Consideration

In many contracts, there is a recital at the beginning stating that the parties to a contract are exchanging something of value. Many contract writers assume that simply stating there is a consideration is enough. In reality, however, recitals do not always satisfy the requirement of consideration. In certain circumstances, it is necessary to provide evidence to the contrary. Here are some examples of consideration-based contracts. Signatories

A contract may have multiple signatories. In other cases, the contract may have an authorised signatory after the title. Remedies

When the parties to a contract to fail to meet their contractual obligations, they may seek to enforce their rights. A contract can include several different remedies, depending on the specific terms and conditions of the contract. The parties may also agree to make certain changes to the contract. This type of remedy is also called a specific performance, and the courts may order a specific performance if they deem it appropriate. In rare circumstances, a court may rewrite a contract.
